“Spotify, Why Do You Keep Hurting Songwriters?”
Join us as we discuss the tensions between the music publishing community and Spotify, in connection with Spotify’s reduction in payment of streaming mechanical royalties to songwriters and music publishers, due to Spotify claiming it qualifies to pay a discounted “bundle” rate for premium subscriptions it characterizes as “Bundled Subscription Offerings.”
Topics of discussion will include the following:
- History of the CRB Phonorecords IV settlement proceeding, as well as the Phonorecords IV’s determination of rates and terms;
- Spotify’s position on reclassifying its premium subscription as a bundled service and why Spotify thinks it’s entitled to a discounted bundle rate, pursuant to Phonorecords IV;
- The Mechanical Licensing Collective v. Spotify USA Inc. complaint;
- NMPA’s outreach to Congress to overhaul the compulsory license in the Copyright Act to “permanently fix the power imbalance” to songwriters;
- NMPA legal complaint against Spotify with the FTC;
- Letter to the US Register of Copyrights from lawmakers, questioning Spotify’s bundling in light of the Music Modernization Act; and
- Other DSPs’ position on bundling (e.g., Amazon Music and YouTube Music) .
We’ll also answer questions after the presentation, time permitting.

Biographies
Charley Londoño | Counsel Plus, Co.; and Of Counsel at The Peter Law Group
Charley Londoño brings a rare combination of specialized entertainment legal services and executive level music industry expertise. Primarily practicing in the areas of music, film, television, and new media, Mr. Londoño counsels both companies and individuals regarding transactional issues. His practice concentrates in the protection, clearance, licensing, and distribution of intellectual property rights.
Prior to beginning his law career, Mr. Londoño was a record company executive. Throughout his career, he worked in the radio promotion departments of Arista Records, A&M Records, IRS Records, and MCA Records.
Mr. Londoño received a B.S. in Business Administration–Finance from the University of Florida and a J.D. from California Western School of Law.
Londoño is a member of the State Bar of California, the Florida Bar Association, the Beverly Hills Bar Association, the Los Angeles County Bar Association, the California Copyright Conference, and the Association of Independent Music Publishers. He is a past president of the California Copyright Conference and instituted its annual Apollo Awards ceremonies.
Ashley Joyce | Senior Vice President, Legal & Business Affairs, NMPA
Ashley Joyce joined NMPA in 2020 and serves as Senior Vice President, Legal & Business Affairs. In this role, Ashley manages NMPA’s Copyright Royalty Board proceedings, copyright infringement litigation, and all related enforcement efforts. Ashley also negotiates model industry settlement and license agreements and supports NMPA’s overall legal, business, and policy objectives.
Before joining NMPA, Ashley was a senior associate at DLA Piper in Washington, DC, focusing on trademark and copyright litigation in federal courts throughout the country, as well as proceedings before the United States Trademark Trial and Appeal Board. For nearly a decade, she litigated cases for clients in the retail, media, and technology sectors, handling all aspects of litigation from pre-suit consultations through appeals. In addition to domestic enforcement matters, Ashley advised clients on international conflicts and Internet issues, as well as exploitation of intellectual property assets with strategic registration, licensing, and settlement efforts.
Prior to DLA Piper, Ashley clerked for U.S. District Judge Garland E. Burrell, Jr. in the Eastern District of California and was a corporate associate at King & Spalding LLP in New York City. Ashley graduated cum laude from Duke University and Washington University School of Law. She is a member of the California, District of Columbia, and New York bars.
Michelle Lewis | CEO, Songwriters Of North America (SONA)
Michelle Lewis is an Emmy-winning songwriter & composer based in Los Angeles, as well as a highly-influential music creators’ rights advocate. The daughter of musicians, she spent her early career in New York City as a recording artist signed to Irving Azoff’s Giant Records after attending Columbia University. But it was upon moving to LA that she had her first radio hit as a songwriter with Cher’s “A Different Kind of Love Song” in 2002. She spent the next 10 years as a go-to top-liner and songwriter, writing hits including the worldwide #1 single “Wings” by the British girl group Little Mix.
For the last decade, Michelle has branched out into the world of songwriting for animated television, most notably as a Peabody Award-winning composer of all original music for Disney Jr’s hit show, Doc McStuffins and Emmy-nominated songwriter of the beloved Nickelodeon series The Loud House. She and her co-writers won an Emmy this past year for Outstanding Original Song for “Unsaid Emily” from the Netflix series Julie and the Phantoms. She has over a half-dozen TV themes currently airing; including Doc McStuffins, The Loud House, Ada Twist, The Harvey Street Kids, Sydney 2 the Max and DC Super Hero Girls.
Michelle is solidly situated on the leading edge of issues facing songwriters as evidenced by her many roles: as SONA’s executive director; as a member of ASCAP’s Board of Directors; as an LA Chapter board member of the Recording Academy, as well as serving on the executive committee of the Music Peer Group for the Television Academy. She is deeply committed to the ongoing fight to make streaming royalty rates more fair to creators, to the education and empowerment of creators through metadata, to the implementation and utilization of the Mechanical Licensing Collective (MLC) and to the fight for songwriters to get healthcare and workplace safety standards in place. In 2019 she won the California Copyright Coalition’s (CCC) Apollo Award and was on Rolling Stone’s “Future 25” list.
Adam Parness | Adam Parness Music Consulting
Adam Parness has over twenty five years of experience in the music and technology businesses, with specialized executive experience in building business affairs, licensing, strategy, operations, and creative relations teams. He currently operates Adam Parness Music Consulting and serves as a highly trusted and sought after strategic advisor to numerous music rightsholders, notably in the music publishing space, as well as popular global brands, technology-based creative services companies, and firms investing in music and technology.
From 2017 to 2019, Adam Parness was the Global Head of Music Publishing at Spotify, where he oversaw all publisher and songwriter related functions, as well as music clearances and licensing for podcasts, audiovisual, and original content. Initiatives managed by Adam during his tenure at Spotify include the formation of Spotify’s first Publishing Operations team, the expansion of Spotify into numerous new countries, Spotify Publishing Analytics- the first analytics tool built specifically for music publishers and songwriters by a digital music service, songwriter and producer credits following years of personal, public advocacy for proper attribution on digital music services, and the purchase of Loudr to increase Spotify’s investment in music publishing technology and composition metadata.
Adam has previously held positions at Pandora Media where he led the company’s movement towards direct licensing in order to expand the company’s product portfolio, Amazon where he was instrumental in
the launches of Amazon Music Unlimited and Prime Music; and Rhapsody International Inc. where he held the position of Vice President of Music Licensing and was instrumental in the acquisition of Napster.
Honored in Billboard 40 Under 40 and a frequent keynote speaker at industry events, Adam is an accomplished musician and obtained a Bachelor of Music from New York University in 2000.
